Insolvency law has become part of the mainstream commercial law and plays a significant economic and social role in contemporary credit economies, the Commonwealth Caribbean being no exception. The insolvent company raises complex issues of law and policy that impact on rights and obligations. This has fuelled a greater focus on the existing legal regulatory framework and its ability to cope with the consequences of business failure. Undoubtedly, amongst the many challenges that globalisation presents for businesses in the Commonwealth Caribbean the issue of the sustainability of companies in this new globalised dispensation will loom large. Thus the philosophy and policies which inform business operations and strategies in the Commonwealth Caribbean must be thoroughly analysed in the context of the legal and regulatory framework within which companies operate. It is therefore important that lawyers and insolvency practitioners in general understand recent developments in insolvency law and increase their awareness of developments internationally, with a view to improving procedures and practices to deal with both existing and new problems.
In this context, the course will consider the fundamentals of business insolvency from a Commonwealth Caribbean perspective while examining the comparative bankruptcy and insolvency regimes. This course combines an analysis of relevant statutory material, concepts and procedures with an understanding of the policy choices in Corporate Insolvency and the different rules which an insolvency regime may play in the contemporary Commonwealth Caribbean society.
